These Terms of Use (“Terms”) govern your access to and use of the ComplyLedge website, API, and related services (the “Service”), operated by Arandu Payments LLC, doing business as ComplyLedge (“ComplyLedge”, “we”, “us”, “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
ComplyLedge provides an API and related tools that organize and serve publicly available U.S. Occupational Safety and Health Administration (OSHA) / Department of Labor enforcement records (inspections, violations, penalties, accidents) keyed to business establishments, so you can look up and retrieve this information programmatically.
To use the paid Service you create a subscription and receive an API key. You are responsible for keeping your API key confidential and for all activity under your key. Notify us promptly of any unauthorized use. You agree to provide accurate account information.
You agree not to: (a) exceed or circumvent rate limits/quotas, or access the Service other than through the documented API; (b) resell, redistribute, or sublicense the data as a standalone or competing dataset or product; (c) use the Service to violate any law or the rights of others; (d) attempt to disrupt, reverse engineer, or gain unauthorized access to the Service; or (e) use the data for any FCRA-regulated purpose (see Section 6). We may suspend or terminate access for violations.
The underlying records are public U.S. government data, provided to you “AS IS.” We do not create the underlying records and do not warrant their accuracy, completeness, timeliness, or fitness for any purpose. Establishment matching and aggregation are performed on a best-effort basis and may contain errors (including mismatches between similarly named businesses). You are responsible for independently verifying any information before relying on it.
ComplyLedge is not a consumer reporting agency, and the Service and its data are not “consumer reports” under the Fair Credit Reporting Act (FCRA) or similar laws. You may not use the Service to make decisions about an individual’s eligibility for employment, credit, insurance, housing, or any other FCRA-permissible purpose. The Service provides information about businesses and establishments, not individuals.
ComplyLedge is an independent service and is not affiliated with, endorsed by, or sponsored by OSHA, the U.S. Department of Labor, or any government agency.
The underlying public records are not owned by us. As between you and us, we own the Service, its software, the organized and derived data, identifiers (e.g., establishment ids), and related intellectual property. We grant you a limited, non-exclusive, non-transferable right to access and use the Service under these Terms during your subscription.
THE SERVICE AND DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPLYLEDGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will indemnify and hold harmless ComplyLedge from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. Provisions that by their nature should survive termination (including Sections 5, 6, 8–11, and 14) will survive.
We may update these Terms; material changes will be posted here with a new “Last updated” date and, where appropriate, notice by email. Continued use after changes means you accept them.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in New York will have exclusive jurisdiction over any dispute, subject to any applicable arbitration agreement.
